제1조 (목적)
이 약관은 젤리랩(이하 "회사")가 제공하는 PixelDiary(이하 "앱")의 이용 조건과 회사와 이용자의 권리·의무를 정하는 것을 목적으로 합니다.
제2조 (이용 계약)
이용자가 Google 계정으로 로그인하는 시점에 이 약관에 동의한 것으로 보며, 이용 계약이 성립합니다.
제3조 (콘텐츠의 권리)
이용자가 작성한 일기와 촬영한 사진의 저작권은 이용자에게 있습니다. 회사는 앱 기능 제공에 필요한 범위(저장·표시·기기 간 동기화, 이용자가 소설 기능을 이용하는 경우 해당 콘텐츠를 소설로 재구성하는 것)에서만 이를 이용합니다.
회사는 이용자의 일기를 광고·마케팅·홍보에 사용하지 않으며, 제3자에게 판매하거나 공개하지 않습니다.
제4조 (소설 집필 기능)
- 소설은 이용자가 작성한 일기를 재료로 자동 생성되는 창작물입니다.
- 원문 일기는 어떤 경우에도 변경되거나 삭제되지 않습니다.
- 생성된 소설의 내용이 사실과 다를 수 있으며, 회사는 그 정확성을 보장하지 않습니다.
제5조 (구독)
- 구독은 각 앱스토어(Google Play, App Store)의 결제 시스템을 통해 이루어집니다.
- 구독 해지·환불은 각 스토어의 정책을 따릅니다.
- 요금과 제공 범위는 앱 내 요금제 화면에 표시된 내용을 따릅니다.
제6조 (실물 책 주문)
- 실물 책은 구독과 별개의 상품이며, 앱 외부의 결제 수단을 통해 주문합니다.
- 실물 책은 이용자의 데이터로 개별 제작되는 주문제작 상품이므로, 제작에 착수한 이후에는 전자상거래법 제17조 제2항 제5호에 따라 청약철회가 제한됩니다. 이 제한은 주문 시 별도의 동의를 받은 경우에만 적용됩니다.
- 상품에 하자가 있거나 표시·광고와 다른 경우에는 위 제한과 무관하게 교환·환불이 가능합니다.
제7조 (금지 행위)
- 타인의 개인정보를 무단으로 앱에 입력하는 행위
- 앱을 역분석하거나 서버에 비정상적으로 접근하는 행위
- 법령에 위반되는 콘텐츠를 저장·유통하는 행위
제8조 (서비스의 중단)
회사는 시스템 점검, 천재지변, 통신사 장애 등의 사유로 서비스를 일시 중단할 수 있으며, 사전에 알릴 수 있는 경우 앱을 통해 공지합니다.
제9조 (책임의 한계)
회사는 무료로 제공되는 서비스의 이용과 관련하여 이용자에게 발생한 손해에 대해 회사의 고의 또는 중대한 과실이 없는 한 책임지지 않습니다. 이용자는 중요한 기록에 대해 별도의 백업을 유지할 것을 권장합니다.
제10조 (준거법과 관할)
이 약관은 대한민국 법령에 따르며, 분쟁은 회사의 주소지를 관할하는 법원을 제1심 관할법원으로 합니다.
1. Purpose
These terms govern your use of PixelDiary (the "app"), operated by Jelly Lab (젤리랩) ("we"), and set out the rights and obligations of both sides.
2. Agreement
By signing in with a Google account you accept these terms.
3. Your content
You own the copyright in the entries you write and the photos you take. We use them only as far as running the app requires: storing them, displaying them, syncing them between your devices, and — if you use the novel feature — retelling them as a novel.
We do not use your diary for advertising, marketing or promotion, and we do not sell or publish it.
4. The novel feature
- The novel is a work generated automatically from the entries you wrote.
- Your original entries are never altered or removed.
- The novel may depart from fact. We do not warrant its accuracy.
5. Subscriptions
- Subscriptions are billed through Google Play or the App Store.
- Cancellation and refunds follow the policy of the store you bought through.
- Prices and what each plan includes are as shown on the plans screen in the app.
6. Printed books
- The printed book is a separate product from the subscription and is ordered through a payment method outside the app.
- Each book is made to order from your own data. Once production has begun, the right to withdraw is limited under Article 17(2)5 of the Korean Act on Consumer Protection in Electronic Commerce. That limit applies only where you gave separate consent at the time of order.
- If the book is defective or differs from how it was described, you may exchange or refund it regardless of the above.
7. Prohibited conduct
- Entering another person's personal data into the app without their permission.
- Reverse-engineering the app or accessing our servers by abnormal means.
- Storing or distributing unlawful content.
8. Interruptions
We may suspend the service for maintenance, force majeure or carrier failure. Where advance notice is possible, we give it in the app.
9. Limitation of liability
For services provided free of charge, we are not liable for loss arising from your use of the app except where we acted with intent or gross negligence. Please keep your own backup of anything that matters to you.
10. Governing law
These terms are governed by the laws of the Republic of Korea. The court with jurisdiction over our registered address is the court of first instance for any dispute.
